1.
DEFINITIONS OF TERMS:
1.1. "Cruise" is an 11-night cruise and seminar-at-sea offered by Susan Shumsky of Divine Travels and Sacha Stone of New Earth Horizons, titled "New Earth Horizons Cruise," which will occur on the Holland America Oosterdam cruise ship, October 1 to 12, 2025.
1.2. "Shore Excursions" are exclusive, unique group tours at port stops on the Cruise, offered by Shore Excursions Organizers.
1.3. "Shore Excursions Organizers" are Divine Travels and its representatives: Luxury Travel Destinations, Holland America Cruise Line, Shore Excursions Group, and any local tour operators that have organized the Shore Excursions.
1.4. "Shore Excursions Descriptions" are details about the itinerary and what is included in the Shore Excursions, posted at http://www.divinetravels.com/Mediterranean2025Excursions.html.
1.5. "Cruise Registration Form" is the agreement form posted at https://www.spiritualityproducts.com/secure/Mediterranean2025Register.html.
1.6. "Shore Excursions Registration Form" is the agreement form posted at
https://www.spiritualityproducts.com/secure/Mediterranean2025ExcursionsRegister.html.
1.7. "Shore Excursion Participant" is a person who has registered for one or more Shore Excursions on the Shore Excursions Registration Form here: https://www.spiritualityproducts.com/secure/Mediterranean2025ExcursionsRegister.html.
1.8. "Shore Excursions Agreement" is this legal document, which is a requirement for each Shore Excursion Participant to agree to, and which is posted at www.divinetravels.com/Mediterranean2025ExcursionsAgreement.html.
1.9. "Shore Excursions Fee" is the payment made by Shore Excursion Participant for participation in one or more of the Shore Excursions.
2. CONDITIONS OF BOOKING: Payment by a Shore Excursion Participant for participation in Shore Excursion(s) constitutes full agreement with the terms and conditions mentioned below.
3. WAIVER OF LIABILITY: The Shore Excursion Organizers are making all arrangements pertaining to Shore Excursions, including reservations and Shore Excursion operation, subject to the condition that the Shore Excursions Organizers will not be held liable for delay, theft, damage, injury, terrorism, cancellation, or irregularities, however caused. The Shore Excursions Organizers will take no responsibility or liability and will issue no refunds for: 1) any changes or delays in transportation schedules, missed carrier connections, or other services; 2) injury, loss, or damage to persons or property; 3) expenses resulting from changes in exchange rates, tariffs, or itinerary; 4) defect in any vehicle or the act or default of any company or person engaged in conveying the Shore Excursion Participants, or in carrying out the arrangements of the Shore Excursions, or otherwise; 5) expenses incurred due to sudden sickness, weather conditions, strikes, war, terrorism, epidemic, pandemic, quarantine, or other causes or acts of God; 6) losses due to cancellations; 7) changes in the Shore Excursion itineraries; 8) physical, mental, emotional, or spiritual injury as the result of participating in the Shore Excursions; 9) disappointment or dissatisfaction about the Shore Excursions.
4. CHANGES IN ITINERARY: Changes to the tentative itineraries in the Shore Excursions Descriptions are anticipated. The Shore Excursions Organizers reserve the right to make any changes that may become necessary in the best interest of the operation of the Shore Excursions, with or without advance notice. Changes will not result in a refund of any portion of the Shore Excursions fees.
5. NO GUARANTEES: There is no guarantee, stated or implied, made by the Shore Excursions Organizers, regarding any aspect of the Shore Excursions. Complaints about the Shore Excursions will not result in any partial or full refund. There is no guarantee, stated or implied, regarding: 1) the number of participants or the age of participants taking the Shore Excursions; 2) whether any particular speaker, presenter, or teacher will attend the Cruise or accompany any specific Shore Excursion; 3) the amount of time that specific teachers or guides will be personally leading any Shore Excursion; 4) photos posted on the Cruise website or visiting any specific sites shown on photos on the website; 5) the quality of meditations, spiritual experiences, or other subjective experiences on the Shore Excursions; 6) any other aspect of the Shore Excursions.
6. RATES: The nonrefundable rates for the Shore Excursions are posted on the Shore Excursions Registration Form. The Shore Excursions Organizers reserve the right to adjust these published rates (higher or lower) prior to the Cruise and during the Cruise. Quoted rates are only valid for period specified. Whenever the full fee is paid for the Shore Excursion, that is when the rate paid by the Shore Excursion Participant is fixed. That paid rate will not change. However, the Shore Excursions Organizers reserve the right to offer and publish different rates for other Shore Excursion Participants (higher or lower) prior to the Cruise and during the Cruise.
7. SHORE EXCURSIONS FEE PER PERSON INCLUDES: 1) Transportation and English-speaking guide for the Shore Excursion; 2) Program, snacks, drinks, food, and free time only as described in the Shore Excursions Descriptions here: http://www.divinetravels.com/Mediterranean2025Excursions.html.
8. SHORE EXCURSIONS FEE PER PERSON DOES NOT INCLUDE: 1) All meals, drinks, and snacks not specified in the Shore Excursions Descriptions. 2) Gratuities for guides. 3) Gratuities and taxes for personal services and purchases. 4) Travel, accident, baggage, health, cancellation, or life insurance. 5) Expenses for guides or transportation not included in the program described in the Shore Excursions Descriptions. 6) Private excursions and recreational activities not mentioned on the program described in the Shore Excursions Descriptions. 7) Any other item unspecified in the program described in the Shore Excursions Descriptions.
9. CANCELLATIONS: All Shore Excursions Fees are completely nonrefundable for any reason. Shore Excursion Participants are advised to get Travel Insurance that covers cancellations in the case of cancellation of any Shore Excursions for any reason, including medical reasons, arriving late for any shore excursion, cancellation of the ship stopping at any port, roadwork or any other impediments to arriving and/or parking at any destination, or cancellation by any local tour operator for any reason. If any Shore Excursion Participant falls ill and therefore cannot attend a Shore Excursion, Shore Excursion Participant is advised to get documentation from the Medical Center onboard the ship in order to file a Travel insurance claim and thereby receive reimbursement.
10. RESERVATION RESTRICTIONS: Any prospective Shore Excursion Participant with a disability, pre-existing medical condition, or medical history requiring special attention or treatment, should advise the Shore Excursions Organizers at time of booking the Shore Excursion and are advised to consult with a medical specialist prior to reserving space in any Shore Excursion. People who are unable to travel alone or who would require special assistance or handling must be accompanied by a companion who will provide the required assistance. The Shore Excursions Organizers assume no responsibility for cases such as these.
11. INSURANCE: All Shore Excursion Participants on the Shore Excursions are strongly advised to get travel, medical, accident, and cancellation insurance. The Shore Excursions Organizers carry no insurance whatsoever for the Shore Excursion Participants. Shore Excursion Participants from the USA are advised to phone the following phone number in order to purchase insurance in case of cancellations or medical needs: 336-749-1219. Shore Excursion Participants from other countries are urged to obtain travel insurance locally.
12. SPECIAL REQUIREMENTS: 1) All Shore Excursion Participants should be healthy in mind and body; 2) All Shore Excursion Participants must have enough prescribed medication to last them while on the Shore Excursions, if undergoing any medical treatment or taking medication; 3) Consult a qualified medical doctor before going on the Shore Excursion; The Shore Excursions Organizers are not responsible for Shore Excursion Participants' health problems during or after the Shore Excursions; 4) The Shore Excursions Organizers are not responsible for lost, stolen, or damaged property during the Shore Excursions; 5) The Shore Excursions Organizers are not responsible for any Shore Excursion Participants who miss getting back to the ship on time because such Participants wandered off and did not stay near the guide the entire time during the tour.
13. WHAT TO BRING: Prepare for sun, clouds, or rain. Weather might be warm, cool, or chilly. It is recommended to bring camera, hat or umbrella to block sun, sunscreen, casual clothing, sweater or jacket, and sturdy, comfortable shoes and socks for walking. Other items to bring, such as bathing suit and towel from the ship for specific excursions, are specified in the Shore Excursions descriptions here, http://www.divinetravels.com/Mediterranean2025Excursions.html, and on the ticket they will receive onboard the ship.
14. PUBLICATION RELEASE: Representatives of the Shore Excursions Organizers may be photographing, audio-recording and/ or video-recording the Shore Excursions. The Shore Excursions Organizers reserve the right to publish any such photographs, audio recordings, and video recordings without obtaining further consent from any participant. Each participant releases The Shore Excursions Organizers and its representatives from any liability in connection with any such use of such photographs, audio recordings, and video recordings.
15. RIGHT TO REFUSE SERVICE: The Shore Excursions Organizers reserve the right to accept, decline, or retain any person as a participant on the Shore Excursions at any time without liability and without any obligation to pay a refund or any other amount whatsoever. The Shore Excursions Organizers take no responsibility or liability for any participant who leaves the Shore Excursions prior to their conclusion or for any activity undertaken by any participant that is not included in the Shore Excursion itinerary.
16. SHORE EXCURSIONS: The exclusive "New Earth Horizons Cruise" Shore Excursions are available only for all those who registered for the Cruise through Luxury Travel Destinations, or on the Cruise Registration Form here: https://www.spiritualityproducts.com/secure/Mediterranean2025Register.html. No one may attend a "New Earth Horizons Cruise" Shore Excursion if their cruise was not booked by Luxury Travel Destinations.
17. WAIVER: The Shore Excursion Participant shall indemnify and hold Shore Excursions Organizers free and harmless from any and all claims, losses, damages, injuries, and liabilities arising from or on account of the Shore Excursions Organizers' activities or omissions in connection with this Agreement, as well as the costs, including attorneys' fees, of defending against them. By signing this Shore Excursion Participant Agreement, the participant releases the Shore Excursions Organizers and its representatives from all responsibility and liability.
18. AGREEMENT: This Agreement may be modified only by the written consent of all parties hereto. This Agreement represents the entire Agreement between the Shore Excursion Participant and the Shore Excursions Organizers with respect to the subject matter hereof. There is no other contract or agreement between the Shore Excursion Participant and the Shore Excursions Organizers, stated or implied, in reference to the Shore Excursions. There shall be no waiver of the rights of the Shore Excursions Organizers by the failure to enforce that or any other right hereunder. If any part of this Agreement is held to be illegal, void, or unenforceable for any reason, such holding shall not affect the validity and enforceability of the rest of the Agreement.
19. AUTHORIZATION: By online signing of the Shore Excursions Registration Form, the Shore Excursion Participant agrees as follows: "I authorize charges to be processed against my credit or debit card account in the amount that I have indicated when I registered at the online Shore Excursions Registration Form. I fully agree to the terms and conditions of this Shore Excursions Agreement. I understand that charges to my credit or debit card account might be made by Shore Excursions Group, Divine Revelation, or both, and I now authorize these charges to be made according to the rates indicated by me on the Shore Excursions Registration Form. I agree that all Shore Excursions payments are completely nonrefundable for any reason."
20. PERSONAL RESPONSIBILITY: By registering for Shore Excursions at https://www.spiritualityproducts.com/secure/Mediterranean2025ExcursionsRegister.html, the Shore Excursion Participant agrees as follows: "I am entirely responsible for my own personal safety, health, and mental, physical, emotional, and general well-being during and after the Shore Excursions. I release the Shore Excursions Organizers and their representatives, and any of their employees, assistants, and affiliates, of any liability for any injuries or damages mentally or physically I or any of my family members might incur during or after the Shore Excursions. Any personal advice, readings, healings, predictions, forecasts, or answers to my questions that are given to me on the Shore Excursions are for informational purposes only and not medical diagnoses or cures. I release Shore Excursions Organizers and their representatives and any of their employees, assistants, and affiliates from any injuries or damages mentally or physically that I or any of my family members might incur during or after the Shore Excursions as a result of following any advice given to me on the Shore Excursions. I release Shore Excursions Organizers and their employees, assistants, and affiliates from any obligation to fulfill any claims about the Shore Excursions that have been printed or spoken in any tapes, lecture, letters, literature, the Internet, websites, or the news media. I am entirely responsible for my personal safety, health, and well-being during the Shore Excursions. I hold the Shore Excursions Organizers harmless for anything that might happen to me or to my possessions on the Shore Excursions. I understand that no health insurance or travel insurance is provided by the Cruise organizers, and, if I wish to be insured, I have to do this myself. I have read and understand the foregoing Shore Excursion Participant Agreement."
21. RELEASE: By agreeing to this Shore Excursion Participant Agreement by signing the registration form at https://www.spiritualityproducts.com/secure/Mediterranean2025Register.html, the Participant releases the Shore Excursions Organizers and their representatives from all responsibility and liability. The Participant authorizes that nonrefundable payments are made for the Shore Excursions of his/her choice. The Participant understands and agrees that all Shore Excursion payments he/she has made with his/her credit card, debit card, cash, check, via Paypal, by bankwire tranfer, or by any other means of payment are 100% nonrefundable for any reason.
